The present general conditions apply to all offers/orders and contracts concluded between Je Fais Tout Cosmetics Paris and the buyer (individual or company). Derogation from these terms and conditions is only possible after written agreement between Je Fais Tout Cosmetics Paris and the buyer. All offers are entirely non-binding and do not oblige the buyer to conclude a contract with Je Fais Tout Cosmetics Paris. The contract is effective when Je Fais Tout Cosmetics Paris has accepted/confirmed the buyer's order in writing.

DELIVERY/DELIVERY TIME/SHIPPING COSTS

Je Fais Tout Cosmetics Paris will make every effort to execute the order correctly. The delivery times indicated in the offers and order confirmations are only indicative. Any delays are not the responsibility of Je Fais Tout Cosmetics Paris and the buyer may not claim compensation for them. Deliveries are always made to the address, unless otherwise agreed. The delivery period begins as soon as the delivery address is confirmed by the buyer to Je Fais Tout Cosmetics Paris.
Je Fais Tout Cosmetics Paris reserves the right to apply different payment conditions depending on the solvency of the purchaser and the geographical area in which the purchaser is located: either payment at the time of ordering depending on the solvency of the purchaser or, for all orders placed outside of Belgian territory, Je Fais Tout Cosmetics Paris will request a prepayment of 100% of the value of the order at the time of confirmation (advance payment). Goods will not be shipped until full payment has been received. Je Fais Tout Cosmetics Paris will not be held responsible for any delay in shipping or delivery caused by non-payment of the order.
Invoices must be paid within 30 days of the invoice date. After the expiration of 30 days from the date of invoice, the buyer shall be liable, without prior notice of default, for conventional interest on the unpaid amount of 8.5% per annum, until the day of full payment. The buyer is also required to pay all judicial and extrajudicial costs to Je Fais Tout Cosmetics Paris.

OBLIGATION TO INSPECT THE PRODUCTS, COMPLAINTS

As soon as the buyer has received the delivery, he/she is obliged to inspect the products and verify that they meet the agreed upon specifications. In the event of a defect, the buyer shall immediately inform Je Fais Tout Cosmetics Paris in writing. This information shall be accompanied by photos if the defects are clearly visible. Claims are accepted up to 7 days following the date of receipt of the products. Any claim made outside of this period cannot be accepted.
The return of delivered products is only possible if the following conditions are fulfilled:
The products are standard products in stock,
Within 7 days of the date of receipt, the buyer has requested in writing that Je Fais Tout Cosmetics Paris take back the products and Je Fais Tout Cosmetics Paris has accepted this request in writing.
The packaging of the products must be as complete and as original as possible, and must not be damaged. Returns are not possible for products made to measure at the request of the buyer. If the products are damaged during delivery, our liability is limited to replacement. Any other expenses or compensation resulting from this will not be reimbursed. Je Fais Tout Cosmetics Paris cannot be held responsible for the abnormal use of products.
The Buyer is entitled to cancel an order/contract within 15 days of the date of the order/contract provided that the Buyer pays the costs resulting from this cancellation. These are agreed upon as a lump sum of 35% of the invoice amount.

PRICES

The prices of Je Fais Tout Cosmetics Paris products are indicated in euros, excluding delivery and insurance costs (FOB).
Apart from delivery costs, the prices of Je Fais Tout Cosmetics Paris products may vary depending on the purchaser's place of residence and/or the delivery address requested by the purchaser. All prices are exclusive of VAT and shipping costs and are only valid for the respective quantities. An offer is valid for up to 30 days from the date of the offer.
Je Fais Tout Cosmetics Paris may adjust the offer and the prices of current items at any time without prior notice. Je Fais Tout Cosmetics Paris is entitled to increase the agreed price in the event of an increase in raw materials, material costs, semi-manufactured products, services or salaries required to execute the contract. The prices of products ordered in writing and paid for cannot be changed.

RESERVATION OF OWNERSHIP

Je Fais Tout Cosmetics Paris remains the owner of the products until the full amount due has been paid. The buyer is prohibited from selling, renting, pledging or lending the products delivered to third parties. As long as the buyer has not respected (or has respected late) his/her payment obligation, Je Fais Tout Cosmetics Paris is entitled to recover the delivered products as owner without formal notice or judicial intervention. The buyer grants Je Fais Tout Cosmetics Paris the right to enter the land or plot of land where the products are located in order to recover them. In the event that the products are recovered, the purchaser shall be obliged to pay Je Fais Tout Cosmetics Paris compensation for the efforts and costs of recovering them, which shall be agreed at a flat rate of 15% of the invoiced amount.

INTELLECTUAL PROPERTY

The entirety of Je Fais Tout Cosmetics Paris products encompassing products (product formulas), logo, photos is the propertý of the latter in accordance with the trademark registration.
Any partial or complete reproduction of this product (formula), logo, brand and photos, regardless of the medium, for commercial, associative or volunteer purposes, is prohibited without the consent of the owner of the brand and the product, who may assert his exclusive right

Damages.
With regard to damages, the liability of Je Fais Tout Cosmetics Paris is limited to damages resulting from serious omission or voluntary intent on the part of Je Fais Tout Cosmetics Paris. Je Fais Tout Cosmetics Paris is not liable for any damage resulting from a deviation from the products/services delivered, or resulting from products/services that do not comply with foreign legal provisions, or resulting from the use of products other than the use for which they were intended. In the event that Je Fais Tout Cosmetics Paris is nevertheless liable, the damages will never exceed the value of the invoice concerned, with a maximum amount of EUR 2,500.

FORCE MAJEURE

Je Fais Tout Cosmetics Paris will do its utmost to fulfill its obligations but cannot be held responsible for delays or non-delivery resulting from circumstances beyond its control, such as strikes, wars, natural disasters or other circumstances that prevent the production, transportation or delivery of products. In case of delay, will fulfill its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.

APPLICABLE LAW

Je Fais Tout Cosmetics Paris will do its best to try to settle any dispute amicably. If you are not satisfied with the method of settling the dispute and wish to appeal to the competent courts, the following rules will apply. The contract is governed by Belgian law. Each party grants exclusive jurisdiction to the courts of Nanterre.
